Unlawful Possession of a Handgun

A local teenager was arrested Tuesday afternoon (May 24) and charged in connection with selling a gun to another teen who was then fatally shot by two other teens shortly after the April 16 gun purchase at Cahoon Park. The seller of the gun had left the park prior to the shooters arriving and shooting into the vehicle occupied by the gun buyer and another teen, both of whom died at the scene as the shooters fled in a vehicle.

Isaiah Gabriel Olivas, 16, was arrested shortly after 1:30 p.m. at his residence in the 700 block of East Fifth Street. Based on the fact Olivas does not meet the state-law age requirement (19) to be in possession of a gun, he is charged with unlawful possession of a handgun and unlawful sale of a firearm. He is also charged with contributing to the delinquency of a minor and tampering with evidence. The tampering charge is related to the Roswell Police Department investigation’s finding that after Olivas learned of the murder of the teen to whom he had sold the gun, Jorge Armendariz, 16, Olivas deleted from his social-media account various messages in which he discussed the sale of the gun with Armendariz before the two met in the park for the transaction.

Armendariz was accompanied by Cameron Luna, 15, who was also shot while in the vehicle. Following the shooting, investigators found in the victims’ vehicle the gun that Armendariz had purchased from Olivas less than an hour before the double homicide.

Jayvin Montoya, 15, believed to be one of the shooters, was arrested in Ruidoso April 25. He is charged with two open counts of murder, as well as one count each of armed robbery, conspiracy (to commit armed robbery), and unlawful carrying of a deadly weapon. Montoya and the second shooter, who has not at this time been charged in the ongoing investigation, are accused of robbing the victims of several items.
