According to federal law, specifically the Equal Protection Clause of the U.S. Constitution, and state law under the New Mexico Human Rights Act expanded by House Bill 207 in 2023, public school districts in New Mexico must accommodate students who identify with a gender different from their biological sex. This requirement includes access to facilities such as restrooms.
The district collaborates with individual students and their families to offer private accommodations. These include single-occupancy restrooms available on every campus to protect privacy and ensure comfort for all students. Options are provided for any student seeking more privacy in school facilities, regardless of gender identity.
During the 2023-2024 school year, Clovis Municipal Schools identified facility improvements through the Facility Master Planning process that align with both student needs and legal expectations. The recently created Facilities Master Plan includes restroom upgrades aimed at enhancing privacy and access for all students. Construction is set to begin soon, increasing the number of single-occupancy restrooms across the district.
The district addressed misinformation about indiscriminate restroom access, clarifying that each accommodation request is handled individually to support student needs while complying with legal obligations designed to ensure equal protection and prevent discrimination.
